One of my visitors sent me an email and made some
recommendations
that I felt people should know, he suggests the following
for those of
you who are only hiring a lawyer to help you obtain an
exemption.
1)
If you do not have a medical reason, the only approach is religious.
Do
not waste time on "the dangers of vaccinations" etc. Rationalism
does
not come into play. The wackier or more extreme, that you come
across
as being, is better.
2) With public school budgets being as tight as they are (complaints
about rising school tax etc.) litigation is costly and they would try to
avoid it. There is the concern that they can get support from the
community by trying to defend it from disease carriers. More often
than
not it appears that these cases do not get publicized.
3) I believe that a response, signed by an attorney, to a rejection
letter from a school would show that you mean business and will not
give
up. Unless it is deemed "unpatriotic" to not immunize, most
schools
should fold at this point. You should be prepared for anything.
4) A competent attorney, like a competent driver on a new road for the
first time, should be able to do the background research on the laws
and, therefore be able to provide good representation.
5)
Folks moving from one area should inquire at the new prospective
schools. A school in the next town etc. may pose no barriers at all and
you can avoid the mess from the beginning. Also, moving to a new
location should not be ruled out if the circumstances are favorable.
6)
Perhaps, what I regret the most is not lying on the school's
immunization questionnaire. "I could have sworn he was up to date on
his immunizations". Is that any worse than trying to get a religious
exemption when your beliefs are based on science?
Here is his email with a brief explanation of
what had happened to
him and his family.
We
were trying to get our son into Highland Elementary School in NY.
He
was refused admittance to 1st grade and ended up in parochial
school.
Somehow (unfortunately) we got a hold of Filenbaum's name.
At the
initial consultation he required a $5,000 retainer, "should we go
into
litigation". We had one more meeting, he wrote a letter to the
school
lawyer, paraphrasing our own "religious philosophy letters,
called their
bluff and we were in. We received no statement or
anything from him
afterwards. I inquired about the balance and he
offered $500. We were
stunned. A formal complaint to the NYS Bar
cabal accomplished nothing.
I
believe, that in our case, and probably most others, any attorney
would
do as schools do not want to spend on litigation. We were
struggling
financially and will never forget being robbed by him.

Instead of recommending particular lawyers, these websites should
offer
strategy guidelines, as, in many cases, starting with the religious
exemption is the only way to go, possibly avoiding the need for these
bloodsuckers. -Alex

A suggestion from me- God forbid if you have to
hire a lawyer because of a vaccine injury and need to file a claim,
interview the lawyers of choice before making a decision of who you want
to represent you. Make sure they have experience in these claims. Once
you have a lawyer of choice.
